Scotland's rent regulation landscape is undergoing significant changes with the expiration of temporary rent adjudication measures on March 31, 2025. These measures, part of the Cost of Living (Tenant Protection) (Scotland) Act 2022 and later extended by the Rent Adjudication (Temporary Modifications) (Scotland) Regulations 2024, aimed to protect tenants from sudden rent hikes during the cost-of-living crisis. The end of these measures brings both opportunities and challenges for tenants and landlords alike.
The temporary measures introduced in 2022 were designed as a response to rising inflation and the need to stabilize household expenses. They included a rent cap of up to 12% and allowed tenants to challenge rent increases through a rent adjudication process managed by Rent Service Scotland (RSS). This system used a taper formula to ensure rents were reasonable and aligned with local market rates. The measures were extended into 2024 but are now coming to an end.

Long-term Proposals: The Housing (Scotland) Bill
While the immediate focus is on the cessation of temporary measures, the Housing (Scotland) Bill proposes longer-term rent control solutions. This bill is in the amendment stage and aims to establish a system where local authorities assess rent levels to determine areas for rent control caps. If passed, rent increases in designated areas could be limited to CPI plus 1% (capped at 6%). However, this legislation is not expected to come into effect until 2027.
